General Conditions of Sale

1. Subject

These General Conditions of Sale govern the purchase of subscriptions to the Menu5Star platform (hereinafter "Service"), a digital SaaS service for creating and managing digital menus for restaurants.

3. Products and Prices

The Service is offered in the following plans:

  • Starter: free, with limited features.
  • Pro: €20.00/month (VAT included where applicable), with a 14-day free trial.
  • Business: €40.00/month (VAT included where applicable), with a 14-day free trial.

Prices are expressed in Euros. For users outside the Eurozone, an indicative price in local currency is shown on the site (marked with the ≈ symbol), but the transaction always occurs in Euros.

We reserve the right to modify prices with at least 30 days' notice. Changes do not apply to current subscriptions until the next renewal.

4. Trial Period

Pro and Business plans include a 14-day free trial. During the trial period, the User has access to all features of the chosen plan. At the end of the 14 days:

  • If the User has entered a valid payment method, the subscription will activate automatically.
  • Without a payment method, the account will be automatically downgraded to the Starter plan.

5. Payment Methods

Payments are securely processed through Stripe. Major credit and debit cards are accepted (Visa, Mastercard, American Express). Payment occurs on a monthly basis with automatic renewal.

6. Invoicing

A digital receipt/invoice is generated for each payment, accessible from the User's dashboard. For Italian VAT invoicing, VAT number and SDI code must be provided.

7. Right of Withdrawal

Pursuant to Art. 59 of the Italian Consumer Code (D.Lgs. 206/2005), as this involves the supply of digital content not supplied on a tangible medium with the express consent of the consumer and waiver of the right of withdrawal, the right of withdrawal does not apply once the supply of the digital service has begun.

However, during the free trial period, the User may cancel at any time at no cost. Additionally, the User may cancel the subscription at any time, effective at the end of the current billing period.

8. Warranty and SLA

Menu5Star guarantees an uptime of 99.5% on a monthly basis. In case of interruption exceeding 24 consecutive hours, documented through a support ticket, the User is entitled to a proportional refund for the unavailability period, calculated as: (hours of unavailability / total hours in the month) × monthly fee.

9. Limitation of Liability

Menu5Star's liability is limited to the total amount paid by the User in the last 3 months. Indirect damages, lost profits, and data loss not caused by provider negligence are excluded. Menu5Star is not liable for service disruptions caused by User connectivity, cyber attacks, or force majeure events.

10. Ambassador and Country Manager Program

Ambassador and Country Manager program commissions are governed by separate agreements. Accrued commissions are paid on a monthly basis upon reaching the minimum threshold of €50.

11. Dispute Resolution

For any dispute related to a purchase, the User may:

  • Open a support ticket from the dashboard.
  • Contact info@menu5star.com.
  • Use the European Commission's ODR (Online Dispute Resolution) platform: https://ec.europa.eu/consumers/odr

In case of failure to resolve amicably, the competent court is that of Bari (Italy), except for mandatory consumer protection provisions.

12. Applicable Law

These Conditions are governed by Italian law and in particular by the Italian Consumer Code (D.Lgs. 206/2005) and the Civil Code.
